Kim Titus on Bloomberg - EVplusEV - 05-16-2014

Here is the response from Kim Titus to Bloomberg today:

RE: Kim Titus on Bloomberg - RacerX - 05-16-2014

This should have come out in the earlier release from IR:

“NQ is working tirelessly with the external auditors to
finalize the audit expeditiously and it is nearing its
conclusion,” Titus wrote in the e-mail. “As we stated on April
30, the investigation has thus far found no incident of fraud;
this will have no impact on previously reported financials.”

Well, at this juncture, you either believe them or not believe them.  For myself, I have doen enough DD and I stick to my LONG call and hold shares and adding here today. Everyone needs to decide whether to stay or say goodbye to NQ.

Can't agree more.  Although Kim Titus may have speaking without lawyers consent.   Nearing its conclusion is an open ended statement as it is always nearing conclusion.  Has anyone had much dealing with Kim?

RE: Kim Titus on Bloomberg - admin - 05-16-2014

Yes, delay in and by itself is a reason for concern but not for alarm. The amount of scrutiny required might be the simple explanation, and the fact that there are no resignations to date and argue no fraud has been found so far provides a modicum of confidence (although for me at least, certainly not full confidence).

A small patch of lottery ticket type calls (far OTM) seems to offer a reasonable play here, IMHO.

I think I feel a lot more comfortable now seeing the email replied from Bloomberg news. He said a little bit more than they can say in the press release. It also confirmed other people's conversation with him. I am more comfortable holding the shares now.

RE: Kim Titus on Bloomberg - elvis00 - 05-16-2014

If and when the audit comes clean, in a sense the delays will establish a firmer understanding that NQ is completely legitimate. The delays will potray a thorough and complete validation of the companies numbers. At that point we can finally go back to fundamentals and most of us agree 10 is fundamentally cheap.

I'd prefer an on time filing of course but this is the half glass full approach I'm going for lol.

Great point! I BELIEVE>>>>> That

1] Management thought that the extra 15 days wold be enough time to file the 20f... Either because of the law firm or independent board members....

2}  Did they ask PWC if they would sign off on the 20f with out Deloitte finishing? Yes and PWC said NO!

3] Is management over their heads with the short attack? Yes

4} should mamagement announce any contracts  no matter how ig before the 20-f No! a waste of time right now!!! best to shut up and focus on getting 20-f DONE!

5] Now we are looking at a $12 stock after 20-f AND clean audit! Maybe...  Damage is done to shareholder trust..

Kim Titus email to Bloomberg

(Updates with company response in fourth paragraph.)
By Ye Xie

May 15 (Bloomberg) -- NQ Mobile Inc., the Chinese mobile-
service provider accused by short seller Carson Block of
overstating revenue, dropped as much as 30 percent after
delaying the filing of its annual report for the second time.
American depositary receipts of NQ Mobile fell to $7.99 at
11:30 a.m. in New York, their lowest level in 10 months. The
shares had tumbled 55 percent through yesterday since Block,
founder of Muddy Waters LLC, said in October the Beijing-based
company was “a massive fraud.” NQ Mobile has denied the
allegation.
“The company is unable to file on time its annual report
on Form 20-F because it needs additional time to complete it,”
Beijing-based NQ Mobile said in a statement today. “The company
continues to work to file its annual report for the year ended
December 31, 2013 as soon as possible.”
NQ Mobile is still working with auditors on a review of its
financial statements, which “has thus far found no incident of

fraud” and is “nearing its conclusion,” Kim Titus, a
spokesman for the company, wrote today in an e-mailed response
to questions on the filing delay.
The company on April 30 delayed the filing of its audited
annual report, known as a 20-F, by 15 days as it waits for the
final results of an investigation into Block’s allegations. The
company said at the time it doesn’t anticipate any changes to
its previously reported financial results and it didn’t provide
an update on the investigation in today’s statement.
Investigation

“The market was expecting something and they didn’t get

anything,” Sachin Shah, a special situations and merger
arbitrage strategist at Albert Fried & Co. in New York, said in
a phone interview today. “No data is negative data. I am
surprised by their comments that they need more time. We are
supposed to have the filing today. It further undermines their
credibility.”
Block, who has become known over the past years for
exposing illicit practices in Chinese companies, didn’timmediately respond to a request for comment on the filing
delay.
Investors have been waiting for the result from the
investigation led by law firm Shearman & Sterling LLP and
auditor Deloitte & Touche Financial Advisory Services Ltd. as a
ruling on whether Block’s assertion that NQ Mobile
misrepresented its financials has merit.
“NQ is working tirelessly with the external auditors to
finalize the audit expeditiously and it is nearing its
conclusion,” Titus wrote in the e-mail. “As we stated on April
30, the investigation has thus far found no incident of fraud;
this will have no impact on previously reported financials.”
