PNG wants Total to develop disputed gas field - energy minister

1:37am EDT

SINGAPORE, Sept 25 (Reuters) - Papua New Guinea wants Total SA to lead construction of a new liquefied natural gas (LNG) export project drawing gas from a disputed field instead of the gas being used to expand an existing giant project, the country's energy minister said.

The South Pacific nation began exports from Exxon Mobil Corp's $19 billion PNG LNG project this year. While an expansion of that project is planned, Papua New Guinea hopes to see French Total lead another LNG export plant.

Total earlier this year bought a 40 percent stake in Papua New Guinea's biggest undeveloped gas deposit, the Elk and Antelope fields, from local firm InterOil Corp.

However, Oil Search, a partner in Exxon Mobil's project, has challenged Total's purchase of the stake, saying it held the right to buy the stake. The dispute is due to go into arbitration in November.

InterOil and Total want to develop the Elk and Antelope fields and build a new LNG project in Papua New Guinea, while Exxon Mobil and Oil Search see the fields as a potential source of gas for an expansion of the PNG LNG project.

PNG energy minister Nixon Duban said gas from Elk and Antelope was unlikely to be fed into the existing plant, and that he would prefer a separate LNG plant to be built.

"For a European company like Total to choose Papua New Guinea gives a lot of prominence to us as an investment destination," Duban, who was attending an LNG conference in Singapore, told Reuters in an interview on Wednesday.

Duban also said he welcomed Exxon Mobil's plan to expand its existing project.

Exxon Mobil said it couldn't comment on the matter. Oil Search managing director Peter Botten, who was also in Singapore at a separate conference, declined to comment. Total did not comment immediately and InterOil did not respond to a request for comment. (Reporting By Jacob Gronholt-Pedersen; Editing by Muralikumar Anantharaman)

The PNG government signed a Project Agreement with Interoil. According to this agreement IOC had to team up with a SM to develop the E/A field. This Project Agreement overruled the IPI-rights regarding preemptive rights. Duban's remark confirms the status quo. For this reason Oilsearch has no chance to gain something with the arbitration.

Nice article dog. Ioc is WAY overdue to comment on several things. This comment by DUBan was likely the cause of the spike yesterday afternoon. Now be a good dog MH and speak.

Relker:   Are you a lawyer?  You are giving a legal opinion which I believe is wrong.

IPI has rights created by contracts.  These are private rights.  The government of PNG cannot alter the terms of private contracts no more than the the U.S. government could.

I am not commenting on what those rights are.  Just that the PNG government cannot take them away.

Steve-An oil and gas lawyer with decades of experience commented on the legal dispute on this board. He owns stock in Interoil. What Relker states was the position of the lawyer. Others might take the time to bump up the thread where this is all discussed.
Further both Total and Interoil have commented on their position that the deal is legit. For more verification the MD and A has comments from Interoil about the arbitration. Best to find the thread and read the lawyers comments and to read the Interoil MD and A comments.
The larger picture per Bernstein and CSFB is it just doesn't matter who wins what matters is the development of the field.
Having 2 Super Majors want to develop your finds is in reality a good thing. Competition is a good thing.

JFT:  Please read what I said.

I have not expreseed any opinion on who will prevail on the preemption isssue.  That is for the arbitration

What  I am saying is that the preemtive right are contracual between two private parties and cannot be taken away by the PNG government as Relker seems to say.

... no more than the the U.S.goverment could.

Perhaps you should follow Exxon's current situation in the Russian deep water Arctic oil exploration project.  XOM has been told by the U.S. Justice Dept that their is no "sanctities" in their contract and their participation with the Russians will cease.

The equation of sorts is the Soverign National Interests of the people (government) of PNG.

Peter (OSH) is in a somewhat polite manner is being told that the Govenment of PNG considers the entry of Total as a operator of a LNG Project is in the PNG National Interest.

While I'm not a laywer, it's somewhat difficult to see how OilSearch can go against the wishes of the PNG government. After all, we've been there before and it seems to me they have ample means to let their preferences prevail..
