Ha! That's a true statement.
A few thoughts:
- if XOM deal was dead, official announcements would have been made already
- if exclusivity was 'material' to announce the first time then it seems it would be material if it has expired
- exclusivity expiration could mean nothing
- exclusivity expiration could be positive per RA above
- exclusivity expiration could be negative in that negotiations continue but aren't going well.
