Sorry, but that plan seems to neglect why is MW involved in this at all. Their allegations go beyond a short conspiracy. MW is going for the juggular and not trying to claim some basic impropriety.
What I think is going on is the author of the article is confusing the purpose of a non-deal road show (which is what NQ was doing for the last year to gain institutional interest in the company). They were actively marketing the company to get new investors. That has nothing to do with the convert offering. As I'm sure NQ had already marketed themselves to the holders of the converts, with those convert holders opting for debt instead of equity.
The only real take away here is that atlantis might have increased their ownership from just under 8% to just under 10%.
