Withdrawal of dissent rejected by XOM attorneys
#1

Although I withdrew my dissent through my broker, the XOM counsel is claiming that it was received BY DTC AFTER THE EFFECTIVE TIME OF THE ARRANGEMENT.  So they are saying they cannot accept my withdrawal, but will come back with an offer in 3 to 4 weeks "that may enable you to receive comparable consideration to what was offered under the arrangement to non-dissenting shareholders."

Any one else withdraw their dissent and then get a letter like this?  This nightmare just keeps on going.  I don't think a $90 offer is coming.

I withdrew on Friday morning Feb 17.  The hearing was Monday the 20th.  I think the court approved it the same day.  If that is correct, then the MIC claims it is in effect as of 12:01 am of that day.  I suspect all other late wihtdrawls are in the same boat.  The IOC saga begins a new chapter, for some.  But ours could be over months ahead of those getting the deal, if their offer is acceptable.  I won't speculate here on what they will offer and would suggest to others not to do so either.

We are in your boat Kaliboo. I do not expect a generous offer. Fully expect to reject the offer and wait on the NAV from the Yukon Courts. If one accepts their offer that means you agree to be harmed and can't collect on a class action law suit because you were not harmed because you accepted an Exxon offer. This is from our US attorney .
