Exxon lawyer comments to a dissenter below
#1

Thank you for your email. Your dissent withdrawal was not received in time to be processed before the closing of the Arrangement, and you should receive a letter from our office confirming same shortly; I have attached a copy of the letter that was sent to you for your convenience.

As a result, your previously-filed dissent notice is still in effect. ExxonMobil is just in the process of finalizing a package that we expect will be sent out by courier in the next few days setting out your options as a dissenting shareholder, including an offer to settle your dissent claim for compensation equivalent to that offered under the Arrangement.

In the interim, if you have any questions, please feel free to get in touch.

Regards,

Kate Andrews

Best shareholder valuation might be received by a Dissenter based on Yukon Court comments and then later collect again if the law suit succeeds .

JFT, how is it that your attorney flopped over on the lawsuit issue? By the written law a dissenter loses all status and rights of a shareholder, including the right to sue. You stated this in your original reason for attempting to withdraw your dissent. However, now you say (after you tried to revoke your dissent) that you still have the right to sue and possibly recover value.

Did you switch attorneys?
Did your attorney fail to timely file your revocation request?
Did the Yukon law change on the right to sue issue?
Did your attorney mess up the first time around in telling you that you would lose the right to sue if you filed dissent?

US vs Canadian lawyer . Different legal system . Different time periods. Different rules . In the US one can file class action law suits .

Per John Christian a Canadian lawyer you can not file a class action law suit in Canada with contingency fees . It's why we retained a US attorney . No out of pocket expenses with the law firm taking on the risk . One would think a practicing attorney in Canada would know more .
