With all the additions, do you believe the earnings should beat expectations? Should we wait until next earnings to bet deep.

Even they miss this time, I believe NQ will increase their guidance in 2014. For the long term investors, missing one quarter is acceptable since NQ still has a brilliant future. (I guess the high legal fee and accountant fee are the major reason to make NQ miss) Now I more concern about the annual report with PWC audited opinion. I heard the annual report must be submitted to SEC at the end of February. That means that the annual report should be near complete. If not, NQ have to file an extension to SEC. Does anyone know the status of the annual report here? Did anyone contact NQ IR Matt about the annual report??

The incremental legal and accounting fees shouldn't figure into adjusted earnings since they'll be considered one-off items. Also, imo, PWC won't be waiting for Deloittes' report to initiate their audit for completing the 20f. Lastly, NQ mgt isnt' going to be able to provide much in the way of timing for yearly and independent audits, other than possibly to say the yearly audit is on schedule. The independent audit should be nearing completion as Deloitte has had plenty of time by now (~ 4-months) to cover all the items in question. All this is just my opinion. GL

The legal and accounting fees (and, maybe even more imortantly, the lost interest income from the term deposits that NQ had to terminate to wire the money into Standard Chartered) would normally be adjusted for by investors and analysts, i.e., as they are non-recurring you would exclude them from Non-GAAP EPS.
As for the independent audit - I would hope that they will finish this before announcing Q4 earnings...certainly that would be very much in the Company's interest as the "overhang" created by the still-oustanding audit report has led the market to under-appreciate all the signiicant operational progress that NQ has made. Certainly Management would not want to have good Q4 results go unnoticed again because everybody is still waiting for the audit...but that is of course all just speculation...
